Tamil Nadu’s ruling party, the Dravida Munnetra Kazhagam (DMK), on Monday filed a writ petition before the Supreme Court challenging the constitutional validity of the Waqf (Amendment) Act, 2025, signalling a serious escalation in the party’s opposition to the central legislation that it says undermines minority rights.
Filed by DMK deputy general secretary and MP A Raja, who also serves on the Joint Parliamentary Committee (JPC) on the Waqf Bill, the petition contends that the amendments to the Waqf Act, 1995, infringe upon the fundamental rights of the Muslim community. The petition has been settled by senior advocate P Wilson.
In a statement, the party said the DMK government, under the leadership of Chief Minister M K Stalin, has consistently worked for the socio-economic upliftment of minorities and backward classes. “The DMK Government had passed a resolution dated 27 March, 2025 moved by the Hon’ble Chief Minister in the Tamil Nadu Legislative Assembly urging the Union Government to withdraw the Waqf (Amendment) Bill, 2025 as it was unconstitutional and adversely affected the rights and interests of the Muslim minority community,” the statement said.
Despite opposition from members of the JPC and various stakeholders, the amendment was passed by Parliament and notified on April 6. The DMK has claimed that critical objections raised in Parliament were not addressed.
The DMK said the party chose to fight it legally as the immediate implementation of the Act infringes and prejudices the rights of about 50 lakh Muslims in Tamil Nadu and 20 crore Muslims in other parts of the country.
The move follows CM Stalin’s announcement on April 3 in the state Assembly that the DMK would approach the Supreme Court.
