The Calcutta High Court on Monday asked the Central Bureau of Investigation to clarify some key aspects of its investigation into the rape and murder of a junior doctor at Kolkata’s RG Kar hospital.

The High Court asked CBI that whether it was considering the possibility of a gang rape in this gruesome incident. The court also ordered the investigating agency to submit the case diary related to its investigation.

Justice Tirthankar Ghosh asked the CBI to answer whether it ever considered investigation under Section 70 of the Bharatiya Nyaya Sanhita (BNS), particularly if multiple suspects were involved in this case.

Justice Ghosh asked the investigating agency to file its report and listed the matter for hearing on March 28. He also directed the CBI to present the case diary on the next hearing date.

Hearing a plea

The court was hearing a plea filed by the parents of the deceased doctor, seeking a fresh investigation into the incident. The parents prayed for a court-monitored investigation.

The Supreme Court earlier allowed the parents of the doctor to move the Calcutta High Court as they were unhappy with the CBI probe and had moved the apex for a re-investigation into the case.

In January, a lower court had pronounced Sanjay Roy, a former civic volunteer with the Kolkata Police, guilty of the rape and murder and sentenced him to life in prison till death.

The junior doctor’s body was discovered in the seminar room of the State-run R G Kar Medical College and Hospital in Kolkata on August 9, 2024. On August 13, 2024, the Calcutta High Court transferred the probe in the matter to the CBI.
